1. Introduction

These Terms of Service (the "Terms") govern your access to and use of the website, dashboard, and digital reputation protection services (together, the "Service") operated by QayemDigital, Inc. ("QayemDigital", "we", "us", or "our").

By creating an account, purchasing a subscription, or otherwise using the Service, you confirm that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy. If you do not agree, do not use the Service.

3. Definitions

"Subscriber" or "you" means the individual who registers an account and maintains an active subscription.

"Subject Person" means the individual whose online presence and reputation are being protected under a subscription. The Subscriber and the Subject Person may be the same individual, or, subject to Section 10, the Subject Person may be a person whom the Subscriber is authorised to represent.

"Target Content" means URLs, images, listings, or other online material identified for removal or delisting.

"Personal Agent" means the staff member assigned by QayemDigital to a Subscriber's case.

"Stripe" means Stripe Payments Company (or the applicable Stripe entity for your jurisdiction), our payment processor. Stripe processes card and other payment-method transactions on QayemDigital's behalf. QayemDigital, Inc. is the seller of record for your subscription.

4. Eligibility

You must be at least 18 years of age to register for and use the Service. By creating an account, you confirm that you are at least 18 years old.

If the Subject Person is a minor or an adult unable to manage their own affairs, the Subscriber must be a parent, legal guardian, or otherwise legally authorised representative of that person, and must be at least 18 years old. We may require documentation evidencing that authority at any time.

5. Account Registration

You agree to provide accurate, current, and complete information during registration and to keep that information up to date. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us immediately at support@qayemdigital.com if you suspect unauthorised access.

We may refuse registration, or suspend or terminate accounts, that violate these Terms or that we reasonably believe are being used for fraudulent, abusive, or unlawful purposes.

6. Description of the Service

QayemDigital provides digital reputation protection services, which may include:

  • Analysing publicly available information relating to the Subject Person;
  • Identifying Target Content across websites, search engines, and third party platforms;
  • Preparing and submitting removal or delisting requests to hosting providers, platform operators, search engines, content distribution networks, and similar parties, under those parties' published abuse, privacy, copyright, and terms-of-service policies, and under applicable law;
  • Escalating unresolved requests through further policy channels and, where appropriate and lawful, through legal counsel retained by or on behalf of the Subscriber;
  • Ongoing monitoring of search engines and platforms for newly indexed material relating to the Subject Person, only where included in the applicable plan and where the Subscriber selected eligible alias-linked leak protection during onboarding;
  • Case management, reporting, and communication through a Personal Agent.

The scope of services available to you depends on the plan you select. A current description of each plan is available at /plans and within your account dashboard.

Account setup may begin after successful payment, along with monitoring where it is included in the selected service. We will not submit takedown or delisting requests to third parties until the Subject Person has successfully completed identity verification and any required authorisation checks.

7. No Guarantee of Outcome

The Service relies on the policies and decisions of independent third parties, including search engines, hosting providers, platform operators, and, where applicable, courts and regulators, over whom we have no control. We will use commercially reasonable efforts to pursue removals and delistings on your behalf, but we do not and cannot guarantee that any particular URL, image, listing, or other item of Target Content will be removed, delisted, or otherwise modified, or that removal will occur within any specific timeframe.

Our fees are paid in consideration of our work and effort on your case, not in exchange for any guaranteed result.

8. Subscription Plans, Pricing, and Billing

8.1 Plans

The Service is offered on a subscription basis under the following plans:

  • Essential: USD 99 per month. Essential includes Google search-result delisting for submitted links, removal notices to site owners or hosts based on the available contact route, and repeated follow-up on unresolved removal requests. Essential also includes Google, Bing, and Yandex search delisting, removal-status checking, continued monitoring, and enhanced support. Eligible leak cases include weekly discovery and a monthly deep scan.
  • Plus: USD 399 per month. Plus includes everything in Essential, escalation to hosting providers, registrars, and relevant ad networks, verifiable evidence captures for unresolved material, an evidence package organized for legal handoff, the option to request a lawyer connection, and priority support. Leak cases also include purpose-built face-search discovery with human review. Eligible username-based protection includes daily Google discovery for up to five usernames or aliases.

Starter is no longer available for new purchase. Existing subscriptions at legacy prices and separately agreed enterprise arrangements continue at their agreed recurring price unless the applicable customer changes plans or the agreement is amended.

Automated weekly or daily username-based searches and wider-network sweeps apply only when the Subscriber selected eligible alias-linked leak protection during onboarding. Face-search features are included with Plus and are not limited to alias-linked cases. DMCA-category cases are manual-link driven unless a separate eligible alias-linked leak protection service is selected.

All amounts are in U.S. dollars and are exclusive of any applicable sales taxes, VAT, GST, or similar transaction taxes. Where required, such taxes will be calculated and added to the price at checkout by our payment processor, Stripe, based on the billing address you provide. You are responsible for the payment of those taxes.

Plan contents, features, and pricing may change from time to time. Price changes will not take effect until the start of your next renewal period, and we will notify you in advance.

8.2 Payment processing

QayemDigital, Inc. is the seller of record for your subscription. Card and other electronic payments are processed on our behalf by Stripe Payments Company (or the applicable Stripe entity for your jurisdiction) ("Stripe"). Stripe operates under its own terms and privacy notice, available at stripe.com/legal/consumer and stripe.com/privacy, which apply to the payment transaction alongside these Terms.

QayemDigital, Inc. is responsible for issuing receipts and tax invoices for the subscription, collecting and remitting any applicable sales tax, VAT, or similar transaction taxes (with Stripe Tax assisting in their calculation), responding to billing inquiries, and processing approved refunds. QayemDigital does not itself receive or store full card numbers; Stripe handles card data as an independent controller under its PCI-DSS Level 1 certification.

8.3 Automatic renewal and cancellation

Subscriptions renew automatically at the end of each billing period (monthly) at the then-current rate, unless you cancel before the renewal date. Unless the checkout clearly states otherwise, each renewal period is one month and the renewal charge is the recurring price shown at checkout.

You can cancel your subscription at any time from inside your account: open Settings, then Plans & Billing, then select “Manage subscription” to open the Stripe-hosted billing portal. No phone call, email, or support request is required.

If you prefer, you may also email support@qayemdigital.com and we will process the cancellation on your behalf, but this is offered only as a convenience; the self-service option above is always available and is the fastest way to cancel.

Cancellation takes effect at the end of your current paid billing period. You retain access until then, and no further renewal charge will be made. Cancellation does not refund or prorate the current paid period except where Section 9 or mandatory law requires it.

8.4 Failed payments

If a scheduled renewal payment fails, Stripe will retry the charge automatically over a short window using its standard dunning-and-recovery process, and we may email you to request an updated payment method. If payment cannot be collected, the Service may be suspended until payment is brought current. Prolonged non-payment may result in account termination.

9. Cancellation and Refunds

9.1 Seven-day window for the initial payment only

You may request a full refund of your first subscription payment within 7 calendar days after that payment, provided that no individualized paid case work has begun. This voluntary window applies only to the initial payment and does not restart or apply to monthly renewal payments.

Individualized paid case work includes human review of scan results where scanning is included, manual case analysis, preparation or submission of a removal or delisting notice, escalation work, evidence capture, or other work performed specifically for your case. An automated pre-registration scan and ordinary account setup do not, by themselves, end initial-payment refund eligibility.

9.2 Renewal payments

Monthly renewal payments are non-refundable. To avoid a renewal charge, cancel before the renewal date shown in your billing account. After cancellation, access continues until the end of the current paid period.

9.3 Incorrect charges and failure to provide the Service

We will correct or refund, as appropriate, a duplicate or incorrect charge, a charge made after your cancellation became effective, or a payment for a period in which we materially failed to provide the paid Service. Contact us promptly with the account email, charge date, and a short description so we can investigate.

9.4 Immediate performance and withdrawal rights

At checkout, you are asked to expressly request that we begin account setup, any monitoring included in the selected service, and other preparatory service work immediately after payment. Takedown and delisting submissions require successful identity verification. If mandatory consumer law gives you a withdrawal or cooling-off right and you withdraw after performance has begun, you may be responsible for the proportionate value of the Service already provided. You lose such a right after the Service is fully performed only where the applicable law permits this and you gave the required express consent and acknowledgment.

9.5 How to request a refund

Contact support@qayemdigital.com from the email address associated with your account. If the request meets this Section 9, we will issue the refund to the original payment method through Stripe. Refunds typically take 5-10 business days to appear, depending on your card issuer or bank.

9.6 Non-waivable consumer rights

Nothing in this Section 9 affects any non-waivable consumer rights available to you under the mandatory law of your country of residence. Where applicable law provides for refund rights that cannot be contractually excluded, those rights continue to apply.

9.7 Payment disputes

Please contact support@qayemdigital.com first if you do not recognize a charge or believe a refund is due; this gives us an opportunity to resolve the issue quickly. Nothing in these Terms limits any lawful card-dispute right or other non-waivable right. We may suspend access while a disputed payment is reversed or remains unpaid, and we may address fraudulent or abusive disputes as permitted by law.

10. Acceptable Use

10.1 Only your own information

You may use the Service only:

  • In relation to online material concerning yourself; or
  • In relation to online material concerning another individual (the Subject Person) who has authorised you to act on their behalf, or for whom you are a parent, legal guardian, or otherwise legally authorised representative.

Where you are acting on behalf of another Subject Person, you must accurately describe your relationship to that person during onboarding (for example: parent, legal guardian, spouse, close relative, or friend acting with consent), and you must provide, on our reasonable request, documentary evidence of that relationship and of the Subject Person's consent, such as a signed authorisation, proof of guardianship, or equivalent. We may decline to begin work, pause work, or terminate the subscription if adequate evidence is not provided.

10.2 Prohibited uses

You must not use the Service:

  • To suppress, alter, or remove content concerning any person other than the Subject Person as defined in Section 10.1;
  • To target journalists, researchers, whistleblowers, or legitimate public-interest reporting on matters of genuine public concern, including accurate reporting on the public conduct of public figures;
  • To conceal content that relates to active criminal investigations, court proceedings, regulatory enforcement, or information you are legally required to disclose;
  • To impersonate any person or entity, or to misrepresent your relationship to the Subject Person;
  • To harass, intimidate, defame, or harm any third party;
  • In violation of any applicable law, regulation, court order, or the intellectual property rights of any person;
  • To upload or submit content that contains malware, or that you do not have the legal right to share with us.

10.3 Our right to decline

We may, in our reasonable discretion, decline to submit specific takedown or delisting requests, decline to work on specific URLs or categories of content, or terminate the Service entirely, if we believe the request or the account is inconsistent with these Terms, with our internal policies, or with applicable law. Where practicable, we will give you notice and an opportunity to provide further information before terminating.

11. Your Content and Licence to Us

To perform the Service we need to process information and materials you provide, including the Subject Person's name and known aliases, photographs submitted for image-based searches, URLs flagged for removal, identity documents submitted for verification, and any supporting documents requested by third parties.

You grant QayemDigital a limited, non-exclusive, worldwide, royalty-free licence to use, store, reproduce, and transmit those materials solely for the purpose of providing the Service to you, including by sharing relevant parts of those materials with hosting providers, platforms, search engines, legal counsel, and other third parties whose cooperation is needed to process your case. This licence ends when you close your account, subject to retention requirements described in our Privacy Policy.

You represent and warrant that you have the right to provide the materials you submit to us for the purposes described in these Terms.

12. Intellectual Property

All rights, title, and interest in and to the Service, including the website, dashboard, software, brand, and materials produced by QayemDigital (other than content you submit), are owned by QayemDigital or its licensors and are protected by applicable intellectual property laws. We grant you a limited, non-transferable, non-exclusive, revocable licence to access and use the Service for its intended purpose during the period of your active subscription.

You may not copy, modify, reverse engineer, scrape, resell, or create derivative works based on the Service or its content, except as expressly permitted by these Terms or by mandatory law.

13. Third Party Platforms

The Service depends on the policies and cooperation of independent third parties, such as search engines, hosting providers, social networks, and content distribution networks. Those third parties are not our agents. We are not responsible for, and do not control, their decisions, response times, privacy practices, or policy changes, and any relationship between you and those third parties is separate from your relationship with us.

14. Confidentiality and Data Protection

We treat information about your case as confidential and disclose it only: (a) to personnel and contractors who need it to deliver the Service; (b) to third parties whose cooperation is needed to process takedown or delisting requests, and only to the extent reasonably necessary; (c) to professional advisers bound by duties of confidentiality; and (d) where required by law or a court order. Our processing of personal data is described in our Privacy Policy.

15. Disclaimers

The Service is provided on an "as is" and "as available" basis. To the fullest extent permitted by applicable law, QayemDigital disclaims all warranties of any kind, whether express, implied, or statutory, including any warranties of merchantability, fitness for a particular purpose, non-infringement, uninterrupted access, and, in particular, any warranty or representation that any Target Content will be removed, delisted, demoted, altered, or otherwise affected.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable mandatory law.

16. Limitation of Liability

To the fullest extent permitted by applicable law:

  • QayemDigital will not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages, or for loss of profits, revenue, goodwill, reputation, business opportunity, or data, arising out of or in connection with these Terms or the Service, whether based in contract, tort (including negligence), strict liability, or any other theory, and whether or not we have been advised of the possibility of such damages;
  • Our total aggregate liability to you for all claims arising out of or relating to these Terms or the Service in any twelve-month period is limited to the amounts actually paid by you to QayemDigital, Inc. for the Service during that period.

Nothing in this Section limits liability that cannot be limited under applicable law, including liability for fraud or intentional misconduct.

17. Indemnification

You agree to indemnify and hold harmless QayemDigital, its directors, employees, and contractors, from and against any third party claims, demands, proceedings, losses, damages, costs, and expenses (including reasonable legal fees) arising out of or relating to: (a) your breach of these Terms, in particular Section 10 (Acceptable Use); (b) information or materials you submit that infringe the rights of, or cause harm to, any third party; or (c) your misrepresentation of your authority to act on behalf of a Subject Person.

18. Suspension and Termination

We may suspend or terminate your access to the Service, with or without prior notice, if:

  • You materially breach these Terms;
  • A payment is not successfully collected and the issue is not resolved within a reasonable period;
  • We reasonably believe the account is being used for unlawful, abusive, fraudulent, or harmful purposes; or
  • We are required to do so by law or a court order.

You may close your account and cancel your subscription at any time as described in Section 8.3. On termination, your right to access the Service ends, and Sections 7, 9, 11 (for work already underway), 12, 13, 14, 15, 16, 17, 19, and 20 survive.

19. Governing Law and Dispute Resolution

These Terms, and any non-contractual obligations arising out of or in connection with them, are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-laws rules.

The state and federal courts located in the State of Delaware have exclusive jurisdiction over any dispute arising out of or in connection with these Terms or the Service, except that we may bring proceedings to protect our intellectual property or confidential information in any court of competent jurisdiction.

Nothing in this Section affects mandatory consumer protection rights available to you under the law of your country of residence.

20. General

20.1 Changes to these Terms

We may update these Terms from time to time. When we do, we will post the updated Terms on this page, update the "Last updated" date, and, for material changes, provide advance notice by email or in the dashboard. Where applicable law requires affirmative consent to a change, including a material change to recurring billing terms, we will request it before the change applies. Otherwise, continued use after the effective date constitutes acceptance. If you do not agree, stop using the Service and cancel your subscription before the change applies.

20.2 Entire agreement

These Terms, together with the Privacy Policy and any plan-specific terms referenced in your dashboard, are the entire agreement between you and QayemDigital regarding the Service and supersede any prior agreements.

20.3 Assignment

You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign these Terms to an affiliate or to a successor in connection with a merger, acquisition, or sale of assets.

20.4 Severability

If any provision of these Terms is held to be unenforceable, the remaining provisions remain in full force and effect, and the unenforceable provision will be modified to the minimum extent necessary to make it enforceable while preserving its intent.

20.5 No waiver

Our failure to enforce any right or provision of these Terms will not be treated as a waiver of that right or provision.

20.6 Notices

Notices to QayemDigital must be sent to legal@qayemdigital.com. We may send notices to you through the email address on your account or through the dashboard.
